These Terms & Conditions (“Terms”) govern the use of https://www.njtechland.com (the “Website”) and any services provided by NJTechland LLC (“NJTechland,” “we,” “our,” or “us”). By accessing our Website or engaging our services, you agree to be bound by these Terms. If you do not agree, you should not use our Website or services.

1. Services Provided

NJTechland provides IT support, consulting, installation, and related technology services.
Service details, scope of work, and pricing will be outlined in individual Statements of Work (SOWs) or service agreements.
All services are subject to availability and scheduling.

2. Pricing & Payments

All pricing will be provided in writing prior to service delivery.
Payments are due as outlined in the applicable invoice or SOW.
Late payments may be subject to additional fees or interest charges.
Any materials, equipment, or rentals purchased for a project must be reimbursed by the client, even in the case of cancellation.

3. Cancellations & Refunds

Refunds are valid only if a dispatch is cancelled at least 4 hours before the scheduled time.
Cancellations within 4 hours of the scheduled time are not refundable.
A minimum site visit fee of $185.00 RBH (includes 2 hours of labor) will be billed once a technician is dispatched.
If materials, lifts, or rentals have been purchased, clients remain responsible for the associated costs.
Rescheduling requests made within 24 hours of the scheduled deadline will incur a $100.00 per technician penalty fee.

4. Client Responsibilities

Clients must provide safe, secure, and accessible work environments free of hazardous materials.
Any delays caused by the client or end user (e.g., lack of access, miscommunication, missing permits) are billable events.
All necessary network devices and specifications (such as for fiber runs) must be provided by the client.
Clients must notify NJTechland in advance if union labor or special permits are required.

5. Limitations & Assumptions

Pricing assumes free and clear cable paths, open conduits, and accessible ceilings (maximum 12 feet height).
Outdoor cabling, multi-floor cabling, or fiber extensions require a separate quote.
Permit fees, union labor, and special site requirements are not included unless otherwise specified.
NJTechland is not responsible for service delays caused by site closures, shutdowns, or COVID-19 restrictions.

6. Intellectual Property

All content, text, graphics, and materials on the Website are the property of NJTechland or its licensors.
Clients may not reproduce, modify, or redistribute NJTechland materials without written permission.

7. Limitation of Liability

NJTechland’s total liability under any service agreement is limited to the total value of the applicable SOW.
NJTechland shall not be liable for indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or business opportunities.
NJTechland is not responsible for failures caused by third-party vendors, ISPs, hardware providers, or client misuse of equipment.

8. Indemnification

Clients agree to indemnify and hold NJTechland harmless from any claims, damages, liabilities, or expenses arising from client use of services, except where caused by NJTechland’s negligence or willful misconduct.

9. Non-Solicitation

For 12 months following the completion of a project, neither party shall directly solicit or hire the employees of the other party who were involved in the project, without prior written consent. General job postings not directed at a specific party are excluded.

10. Dispute Resolution

Any disputes shall first be attempted to be resolved through good-faith negotiation.
If unresolved, disputes will be settled by binding arbitration under the rules of the American Arbitration Association (AAA).
Arbitration will take place in New Jersey, and the decision will be final and binding.

11. Governing Law

These Terms shall be governed by and construed under the laws of the State of New Jersey, without regard to conflict of law principles.

12. Modifications to Terms

NJTechland reserves the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our Website. Continued use of our Website or services after changes constitutes acceptance.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
